Southeast Water Wars

Consultants with Global Energy & Water, LLC have represented our client for more than 15 years. Prior to that our consultants, then working for The Southern Company, were engaged in representing the issues effecting Southern Company's power generation resources reliant on these two basins for cooling water and for hydroelectric generation. Our consultants have been involved in all aspects of the negotiations and litigation for more than 20 years since the initiall lawsuits were filed in 1990. Considering the many twists and turns during the 20 years, our consultants have steadfastly presently sound techncial solutions to the issues that have become mired in federal litigation.

WHile the 11th Circuit Court of Appeals ruled in the Summer of 2011 that Water Supply is an authorized purpose of Lkae Lanier (Buford Project), their decision left significant issues undecided. The single largest issues yet to be resolved is the development and release a new Draft Water Control Manaual for the ACF Basin including Lake Lanier. This is not scheduled to be completed for another 2 years. Until the Draft is released for Public review, decisions by stakeholders on the future use of the ACF resources is on hold.  

Our experience with Corps of Enginner Policy and Regulations, Eastern Water Law, as well as, hydrologic and operations modeling of multi-purpose reservoir systems continues to be a significant focus in this engagement.

 

  

 

 

For over 30 years, technical and legal disagreements between the states of Alabama, Florida, and Goorgia over the allocation of interstate waters of the Alabama-Coosa-Tallapoosa River Basin ("ACT") and the Apalchicola-Chattahoochee-Flint River Basin ("ACF") have impeeded the discision making abilities of all stakeholders in both basins to provide for future water supply, industrial and process water, water for power generation and recreational opportunities.
